Expungement

Just because you made a mistake in the past, doesn’t mean it has to haunt you for the rest of your life. Certain criminal convictions and arrests can be expunged from your record in Oregon. Expungement is available for misdemeanors and Class C felonies. It is not available for sex crimes, traffic crimes, criminal mistreatment or class A or B felonies.

If you have a qualifying misdemeanor or Class C felony on your record, you may have it removed after three years. You must have completed the terms of your probation and have no other convictions on your record in the past 10 years.

Once you have met those criteria, you will need to take a few easy steps to have your record expunged. You will need to file a motion to set aside the conviction in the court where you were originally convicted. You must also file a copy of this motion with the District Attorney’s Office.
